Privacy Policy

This policy explains how Vexability ("we", "us") collects, uses, stores and discloses personal information. We handle personal information in line with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs), and we handle commercial electronic messages in line with the Spam Act 2003 (Cth).

The short version: we collect the details you give us so we can run your free visibility check and deliver our services. We never sell or share your details with anyone unless you explicitly tick the optional partner box on our form — and saying no changes nothing about your free check. You can ask what we hold about you, ask us to correct it, delete it, or withdraw consent at any time.

1. Who we are

Vexability is a Melbourne-based service that helps Australian trades businesses get recommended by AI tools (such as ChatGPT, Gemini and Perplexity) and found on Google. You can contact us about anything in this policy:

2. What we collect

Information you give us. When you fill in our free visibility check form or contact us, we collect what you provide: your name, business name, trade, suburb, phone number and email address.

Publicly available business information. If we contact your business about our services, we use details that are already publicly listed — for example, your business name, trade, suburb and public contact details from directories, Google, or your own website. We only use this to contact you about services relevant to your business, and every message we send includes a working unsubscribe link.

Information collected automatically. Our website is a static page and does not set tracking cookies or run analytics scripts. Our hosting provider and content delivery networks may log standard technical data (such as your IP address and browser type) to serve the page and protect against abuse.

We do not collect sensitive information (such as health, religious or political information), and we do not knowingly collect information from anyone under 18.

3. Why we collect it

We collect and use personal information to:

  • run your free visibility check and send you the results;
  • respond to your enquiries and provide quotes;
  • deliver the services you engage us for, including audits, implementation work and monthly visibility reports;
  • send you relevant information about our services (you can opt out at any time); and
  • meet our legal obligations.

We do not sell, rent or trade personal information without your express consent. The only exception is the optional partner sharing described in section 5 — and that only ever happens if you ticked the box asking us to.

4. Who we share it with

We only share personal information with service providers we use to run the business, and only what they need to do their job:

  • Form handling: our website form is delivered by FormSubmit, which passes your submission to our email. FormSubmit may process data outside Australia.
  • Email delivery: we use standard email providers to send and receive messages, which may store data outside Australia.
  • Website delivery: our fonts and animation scripts load from content delivery networks (Google Fonts, Cloudflare cdnjs), which see standard request data such as your IP address.

When testing your visibility, we submit queries about your business (for example, "best plumber in Brunswick") to AI platforms — we do not submit your personal details to those platforms.

Where information is processed overseas, we take reasonable steps consistent with APP 8 to ensure it is handled in line with the Australian Privacy Principles. We may also disclose information where required by Australian law.

5. Sharing with partners — only if you say yes

Our free visibility check form includes an optional, unticked checkbox asking whether you'd like your details shared with trusted partners who offer services relevant to trades businesses — for example insurance, finance or equipment suppliers. If you tick it:

  • we may provide your name, business name, trade, suburb, phone and email to those partners, who may contact you about their services;
  • we only work with partners who agree in writing to handle your information in line with Australian privacy law and to honour opt-out requests; and
  • we keep a record of your consent, including when and how it was given.

If you don't tick the box, nothing is shared — full stop. Your free check and any services you engage us for are exactly the same either way; consent is never a condition of service.

Changed your mind? Email kessan@vexability.com.au and we'll stop sharing your details immediately and tell any partner we've already passed them to that you've withdrawn consent. Withdrawal doesn't affect anything else about our service to you.

6. Marketing emails and the Spam Act

Any commercial email we send complies with the Spam Act 2003 (Cth): it clearly identifies Vexability as the sender, includes our contact details, and contains a functional one-click unsubscribe link. Unsubscribe requests take effect as soon as possible and always within 5 business days. Once you unsubscribe, we keep your address on a suppression list solely to make sure we never email you again.

7. How we store and protect it

We store personal information in access-controlled systems and keep it only as long as we need it to provide services, resolve disputes or meet legal obligations. When it's no longer needed, we delete or de-identify it. No internet transmission is completely secure, but we take reasonable steps required by APP 11 to protect information from misuse, interference, loss, and unauthorised access.

If a data breach occurs that is likely to result in serious harm, we will notify affected individuals and the Office of the Australian Information Commissioner (OAIC) as required by the Notifiable Data Breaches scheme.

8. Access, correction and deletion

You can ask us at any time to:

  • tell you what personal information we hold about you;
  • correct anything that's wrong or out of date; or
  • delete your information (we'll do so unless we're legally required to keep it).

Email kessan@vexability.com.au and we'll respond within 30 days, usually much sooner. There's no charge for making a request.

9. Complaints

If you think we've mishandled your personal information, contact us first at kessan@vexability.com.au — we'll investigate and respond within 30 days. If you're not satisfied with our response, you can complain to the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au or by calling 1300 363 992.

10. Changes to this policy

If we change this policy, we'll post the updated version on this page with a new "last updated" date. Significant changes affecting how we handle your information will be communicated to active clients directly.
