These terms cover both the use of this website and the services Vexability ("we", "us") provides. By using this website, requesting a free visibility check, or engaging our services, you agree to these terms. If you engage us on behalf of a business, you confirm you're authorised to accept these terms for that business.
The short version: the visibility check is free with no obligation. The audit is a fixed price. Ongoing management is month to month with no lock-in — you can stop any month. We guarantee the work gets done and proven; nobody can guarantee what Google or an AI tool will recommend, and we don't pretend otherwise.
1. Who we are
Vexability (ABN 57 759 834 486) is a Melbourne-based service that helps Australian trades businesses improve their visibility in AI tools (such as ChatGPT, Gemini and Perplexity) and on Google. Contact: kessan@vexability.com.au · +61 481 862 081.
2. The services
- Free visibility check. We test how your business shows up across AI tools and Google for your trade and suburb, and send you the results. Free, no obligation, no strings.
- Visibility audit — $500. A full review of your Google Business Profile, reviews, directory listings and website, with a written list of what needs fixing.
- Implementation. Quoted after the audit, based on what actually needs doing. The quote is fixed once you accept it.
- Ongoing visibility management — $400/month. Continuous work on your profile, reviews, listings and pages, plus a monthly report showing what we did and how you're tracking. Month to month, no lock-in contract.
All prices are in Australian dollars. Where we're required to charge GST, prices will be stated inclusive of GST on your invoice.
3. What we don't promise
Search engines and AI platforms (Google, OpenAI, Anthropic and others) control their own results and change how they work without notice. We do not and cannot guarantee any specific ranking, recommendation, placement, traffic level, lead volume or revenue outcome. Anyone who guarantees those things is not being straight with you.
What we do promise: the work described in your audit or monthly plan gets done, and you get honest monthly reporting showing exactly what was done and how you're showing up in our tests — whether the numbers are moving or not.
4. Payment and cancellation
- The audit fee is payable before the audit begins. Implementation is payable as set out in your quote.
- Monthly management is billed in advance each month.
- You can cancel monthly management at any time by email or phone. Cancellation takes effect at the end of the current billing month — no cancellation fees, no notice period beyond that.
- If an invoice is more than 14 days overdue, we may pause work until it's paid.
5. What we need from you
To do the work, we need you to provide accurate business information, reasonable access to the accounts involved (such as your Google Business Profile and website), and timely responses when a decision is yours to make. You confirm that information you give us about your business is true — we can't be responsible for problems caused by inaccurate details, and platforms may penalise listings containing false information.
6. Ownership
Everything we create for you — audit documents, page content, listing copy, reports — becomes yours once it's paid for. Your Google Business Profile, website and accounts are always yours; we never hold them hostage. Our internal tools, templates, testing methods and know-how remain ours. The content and design of this website belong to Vexability and may not be copied for commercial use without permission.
7. Australian Consumer Law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)), including that services will be provided with due care and skill, be fit for purpose, and be supplied within a reasonable time. Nothing in these terms excludes, restricts or modifies those guarantees or any other right you have under law that cannot be excluded.
For a major failure with a service, you are entitled to cancel your contract with us and obtain a refund for the unused portion, or to compensation for its reduced value. You are also entitled to compensation for any other reasonably foreseeable loss or damage. If the failure is not a major failure, you are entitled to have the problem fixed within a reasonable time.
8. Liability
To the extent permitted by law (and subject to section 7, which always prevails):
- our total liability for any claim arising from the services is limited to resupplying the services or refunding the amount you paid for the services giving rise to the claim, whichever we reasonably choose;
- we are not liable for indirect or consequential loss such as lost profits or business interruption; and
- we are not liable for the actions, outages, policy changes or results of third-party platforms (including Google, AI platforms and directories) that we don't control.
Nothing in these terms limits liability that cannot lawfully be limited, including liability for fraud.
9. Using this website
This website is provided for general information about our services; it isn't professional advice for your specific situation. You agree not to misuse the site — including scraping it, submitting false or automated form entries, or attempting to interfere with its operation. We may update site content at any time. Links to third-party sites are provided for convenience; we don't control or endorse their content.
10. Privacy
Personal information you provide is handled under our Privacy Policy, which forms part of these terms.
11. Ending the relationship
Either of us can end an ongoing engagement with notice as set out in section 4. We may end or suspend services immediately if you seriously breach these terms (for example, non-payment after reminder, or asking us to do something unlawful or against platform rules). If we end the engagement without cause part-way through a paid period, we'll refund the unused portion.
12. General
- Governing law: these terms are governed by the laws of Victoria, Australia, and both parties submit to the courts of Victoria.
- Changes: we may update these terms by posting a new version here. For existing clients, changes take effect from your next billing month, and we'll flag material changes to you directly.
- Severability: if part of these terms is found invalid, the rest still applies.
- Entire agreement: these terms, your quote and our Privacy Policy make up the whole agreement between us, replacing prior discussions.
